Businesses using Zerate to send commercial email must comply with applicable email marketing laws, including CAN-SPAM (United States), CASL (Canada), GDPR-related e-privacy rules (Europe), and other regional requirements.
1. Sender Requirements
You must:
- accurately identify the sender, brand, or organization;
- use truthful and non-deceptive subject lines and headers;
- include a valid physical postal address;
- provide a functional opt-out or unsubscribe mechanism that complies with legal requirements;
- honor opt-out requests promptly (within legally required timeframes);
- maintain suppression lists and ensure unsubscribed recipients are not contacted; and
- not use false, spoofed, or misleading routing information.
2. Consent and Transactional Exceptions
Before sending commercial email, you must have the appropriate legal basis or consent as required by applicable law. Some messages (such as purely transactional or relationship-based messages) may be subject to different requirements under applicable law.
3. Prohibition on Purchased Lists
Sending messages to purchased, rented, or scraped email lists without proper consent is prohibited.
4. Platform Responsibility
Zerate provides email infrastructure but does not monitor all content. Business senders are solely responsible for ensuring that messages comply with applicable law.
